Terms of Service

• "Account" — your registered user account on the Platform.
• "Content" — any data, code, text, files, or other materials you submit, upload, or create through the Platform.
• "Consumer Key" — an API credential issued to end users of your project, scoped to specific features and quotas you configure.
• "Developer" — a user who creates projects, publishes marketplace listings, or deploys edge functions on the Platform.
• "Edge Function" — serverless code you deploy and run on Cloudflare's global edge network via the Platform.
• "Marketplace" — the community listing system for sharing functions, MCP servers, skills, and agents.
• "Plan" — the subscription tier (Free, Starter, Pro, Business, or Enterprise) associated with your Account.
• "Services" — all features and APIs provided by the Platform.

• You must be at least 16 years old to create an Account.
• You must provide accurate and complete information during registration and keep it up to date.
• You are responsible for maintaining the security of your account credentials. You must not share passwords or API keys.
• You are responsible for all activity that occurs under your Account.
• You must promptly notify us at security@aerostack.dev of any unauthorized access to your Account.
• Aerostack reserves the right to refuse registration or suspend Accounts at our discretion.

You may use the Platform only for lawful purposes. You must not:

• Violate any applicable law or regulation.
• Transmit malicious code, viruses, or disruptive software.
• Conduct DDoS attacks, port scans, or unauthorized penetration testing against Aerostack infrastructure or other users' projects.
• Circumvent rate limits, quota enforcement, or access controls.
• Scrape, crawl, or systematically extract data from the Platform without prior written consent.
• Impersonate any person or entity or misrepresent your affiliation.
• Use the Platform to generate, distribute, or facilitate spam, phishing, or fraudulent content.
• Exploit the Platform to mine cryptocurrency or perform computationally abusive workloads unrelated to legitimate API use.
• Use the AI Gateway or AI features to generate content that is illegal, abusive, or violates applicable AI usage policies of the underlying model providers.
• Reverse-engineer, decompile, or attempt to extract the source code of proprietary Platform components.

Violation of this section may result in immediate suspension or termination of your Account without refund.

• Paid Plans are billed in advance on a monthly or annual basis via Stripe.
• All fees are in USD and exclusive of applicable taxes. You are responsible for any taxes arising from your use of the Platform.
• Subscriptions auto-renew unless cancelled before the billing cycle ends.
• Failed payments will be retried. If payment fails after reasonable retries, your Account may be downgraded to the Free Plan or suspended.
• Promotion codes and coupons may be applied at checkout. Discounts are non-transferable and subject to their stated terms.

Annual subscriptions may be refunded on a pro-rated basis within 14 days of the initial purchase if you are dissatisfied. Monthly subscriptions are generally non-refundable except where required by applicable law. Refund requests must be submitted to billing@aerostack.dev.

Usage-based charges (overages) are non-refundable.

• By publishing a function, MCP server, skill, or agent to the Marketplace, you grant other users a non-exclusive license to use it under the terms you specify in the listing.
• Marketplace listings must not violate these Terms, third-party IP rights, or applicable law.
• Aerostack may remove any Marketplace listing that violates these Terms without prior notice.
• Aerostack does not warrant the quality, security, or fitness of third-party Marketplace listings. You use them at your own risk.

The Platform, including its source code, UI, branding, logos, and documentation, is owned by Aerostack Inc. and protected by copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right to use Aerostack's trademarks, trade names, or branding without prior written consent. Open-source components of the Platform are licensed under their respective open-source licenses.

Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Each party agrees to keep the other party's non-public information confidential and not to disclose it to third parties except as permitted by these Terms or required by law. This obligation does not apply to information that is publicly known, independently developed, or rightfully received from a third party without restriction.

• By you: You may cancel your account at any time via the dashboard. Upon cancellation, your data is retained for 30 days before deletion.
• By Aerostack: We may suspend or terminate your Account immediately for violation of these Terms, non-payment, or activity that threatens the Platform or other users.
• Effect of termination: Upon termination, your right to use the Platform ceases immediately. We will provide a reasonable window to export your data, except in cases of termination for cause.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. AEROSTACK EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Aerostack does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AEROSTACK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION — ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF AEROSTACK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

AEROSTACK'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO AEROSTACK IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. If those laws apply to you, the above limitations may not apply in full.

You agree to defend, indemnify, and hold harmless Aerostack and its affiliates, officers, directors, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your Content; (c) your violation of these Terms; or (d) your violation of any third-party right.

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law provisions. For users in the European Union, mandatory consumer protection laws of your country of residence may also apply.

We may modify these Terms at any time. For material changes, we will provide at least 14 days' notice via email or an in-dashboard notice before the new Terms take effect. The "Last updated" date at the top reflects the most recent revision.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the new Terms. If you disagree with the changes, you must stop using the Platform and cancel your Account before the effective date.

• Entire Agreement: These Terms, together with the Privacy Policy and any order forms or addenda, constitute the entire agreement between you and Aerostack regarding the Platform.
• Severability: If any provision is held unenforceable, the remaining provisions remain in full force.
• Waiver: Failure to enforce any provision is not a waiver of future enforcement rights.
• Assignment: You may not assign these Terms without our prior written consent. Aerostack may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Force Majeure: Neither party is liable for delays caused by circumstances beyond its reasonable control.
• Notices: Legal notices to Aerostack must be sent to legal@aerostack.dev.
